The Probable Cause for this search and seizure is tainted and would not be valid in a courtroom at trial. It would be surely challenged by the defense attorney and likely suppressed as evidence and determined to be inadmissible at trial resulting in the criminal charges being dropped by the prosecuting attorney. The original basis for the detention was based on faulty information and did not fit the description provided in the Amber Alert bulletin. Attention to detail matters! The police also engaged in intimidation and insulting behavior. Not professional but legal unfortunately! The typical let me search because you have nothing to hide ploy is used and items that would be determined to be contraband are then used for additional criminal charges for the other passengers. 😠 This video is a perfect example of how seemingly good intentions by police can end wrong when over zealous actions or pressure by superiors can cloud judgment NOTE:. *Seemingly harmless admissions and acknowledgments can provide significant damage so this is why remaining silent is so critical in police encounters. *Do not consent to any search of your vehicle or property because others may have been in possession of those items and used them for what can be considered criminal behavior. Taking a family member to the drug store to fill a prescription and a bottle is accidentally left behind because it falls under the seat but found in a search by police can provide the evidence to arrest if the drug was a controlled substance. If you do not know your rights, you may as well not have any! 😞 This is why I am thankful I went to the police academy and the education from getting my criminal justice degree to know my rights and limits of law enforcement.
