The Supreme Court ruled 9-0 yesterday that isolated human genes cannot be patented. The historic decision will provide access to high-risk patients who previously could not afford the expensive tests that patent laws protected. It also highlights the debate over the ability of some to patent, and therefore monopolize, on scientific knowledge. “I think this issue of knowledge and freedom of genomic knowledge is something that will be critical in the years to come,” says our guest Judge Robert Sweet, the senior federal judge for the Southern District of New York who originally invalidated Myriad Genetics’ patents in the case.
