The Writ of Habeas Corpus was suspended by President Lincoln during the civil war, who became the first sitting president to defy both remaining branches, and declared war on Americans simultaneously. Lincoln committed treason as only congress had the power of suspension under Article I Section 9 of the Constitution. Which it did not give. The the Supreme Court was also ignored by Lincoln during the civil war. . Immediately after the assassination of President Lincoln, the United States Supreme Court granted the writ and once again established that (once again) only Congress had the power to suspend the Writ of Habeas Corpus and ruled that the military had no jurisdiction over civilians, nor their freedoms in the post civil war South.
