Australia has non-refoulement obligations under both the refugee convention and the convention against torture: No State Party shall expel, return [refouler] or extradite a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture. It doesnt get more straight forward than that. Those obligations also form part of our domestic law because that article from the torture convention is incorporated into the Migration Act.
