The determination this man had. Given the fact that he would have had to exhaust the 602 process, this man has the balls every inmate should have. Day in and day out punk attitude guards toss lockers, brake tvs, ruin pictures, throw away food, etc. Most inmates just let it go because the 602 - g22 has to be acknowledge by the very officer or his fellow officer its against. Once you put on paper a grievance against a cop your on the shit list with every cop from the tower to visiting. That is the reason most short timers wont file them and if so you pay off a lifer for filing the complaint. Guards and inmates know the 602 process was specifically set up to strategically limit grievances, and sabotage - stone wall a inmates right to sue. In fact even the legislatures in Sacramento are aware of it but they just turn their heads and say CDCR exercise your regulatory authority to fix it... and by fix it they mean make a system that virtually eliminates suits of wrong doings against the state and department. So it usually is about principal when you finally get this far. When you have nothing everything is valuable. With out looking at the merits of his case, we will still commend him for standing up naming those P.O.S. and yanking their covers. Really some of us know and others have no clue what he has gone thru to retain some dignity. Psst CA Legislatures ..... You gave CDCR regulatory authority PC 5054-5058... Based on that power Title 15 exists. Where in Title 15 do you find the process and procedures that were violated resulting in this man filing the suit? You wont because CDCR dont run under Title 15 like you would like to believe they do. Not every matter should be in front of a Judge.
