The discussions that led to the original Bangsamoro agreement were not as open as they might have been, giving rise to questions and doubts, particularly on the constitutionality of some provisions. The agreement included provisions on power-sharing and wealth-sharing, on police powers and a court system, and even a regional government led by a prime minister, that seemed out of sync with the nation’s presidential system of government. From the beginning, legal circles were expressing doubts about the constitutionality of some of the provisions of the agreement. Then it was announced by MILF quarters that certain provisions of the Philippine Constitution will have to be amended if the Bangsamoro agreement is to take effect. An organization of Moro women complained outright that the government panel was trying to change most of the agreed provisions to suit the Philippine Constitution. Is that really the agreement which the government panel signed – an agreement which is not now in accordance with the Constitution? Is that the agreement which the MILF now insists must be followed or the fighting resumes in Mindanao?
