The law is the law not anybodys educated guess, logic or what they choose to call common sense. A Judge may chose to exercise discretion under certain compelling circumstances but if theres no such compelling circumstances such as serious illness, why should the Judge grant? And l heard another educated logic that ooh the offenders peak season which is December(as a musician) could be a reason for granting bail and if the Judge doesnt then hes perpetrating injustice. Some educated people are wading into territories which their so-called education doesnt permit them but instead of they having the humility to learn theyve allowed their emotions and love for alleged offenders to cloud their reasoning. Lawyer Sampson Lardi writes; But when I read that law I dont find subject superior officers discretion in there. (7) A court shall refuse to grant bail— (a) in a case of treason, subversion, murder, robbery, hijacking, piracy, rape and defilement or escape from lawful custody; or [As amended by the Criminal Procedure Code (Amendment) Act, 2002 (Act 633), s. (7)]. (b) where a person is being held for extradition to a foreign country.....and in 2007 narcotics were added. The law doesnt say where the offender is popular and has known place of abode and not flight risk or hasnt got the intention of distributing narcotics. People should not create their own set of laws and invite the Judges to interpret it for them the way they deem fit. Some educated people claim to hate what in their eyes is injustice if court refuse bail base on the law yet they see absolutely nothing wrong with deviant behaviour, if a Musician know that December is his peak season why should he go smoking marijuana in November? Worst of all 20 meters away from a Police barrier. Smoking a banned substance anywhere is unacceptable but if Madness preacher chooses to smoke it at noses of the Police what justification does the police have for not arresting such a deviant in society?
