The proposed judicial appointments commission incorporates in some significant sense the old collegium system. This is set to contain 3 judges of the Supreme Court, including the Chief Justice. The eminent persons may include past jurists like attorney generals and observers of the judiciary, judgements, correctional appeals and courts. Or, this proposed system is highly likely to invest the system of judicial appointments with a high level of legal informedness and knowledge about men and matters relating to courts. The appointments commission is sure to immunise the system against the possible political prejudice or a mix up between the judiciary and executive. The courts have primarily to adjudicate about the legality and constitutionality of private and government actions, laws and rules. And therefore the judges have to be transcending the narrowness of political interests of the government of the day; and seek to bring high objectivity into deliberations. Notwithstanding these hopes and possibly good intentions, there are always manifest attempts to delay justice and contrive miscarriage of justice; and these are by governments men and their supporters and beneficiaries. Often it may not be wrong to say that political power is largely sought to attain a vantage status Vis a Vis judiciary, to seek impunity against several kinds of misdemeanours, corruption, accumulation of tons of black money, violations of electoral law, genocide and encounter killings etc., all common and familiar in Indias political circles. India is not a kangaroo court country and rule of law is said to prevail; but even then, there are shameful instances of violation and large swathes of Indians, minority Muslims and women and other backward sections, suffering from systemic prejudice and demonization and ascriptional criminalisation. All these dark and anti-civilisational features of Indian state, society and government can go or at least diminish if there develops increased understanding and adherence to the Countrys Constitutional values, the legacy of the freedom movement of India, the inclusive culture and civilisation of India.
