An application was made to the European Food Safety Authority (EFSA) dated 24th June 2014 for the release of the two critical chronic toxicity studies which were used to set the Acceptable Daily Intake (ADI) of Glyphosate, including for the food pathway. As expected this application was refused, due to this data being currently protected due to “commercial interests and intellectual property rights”. However a judicial appeal (lawsuit) can be filed up to the 9th October asking an EU court of the first instance to make a legal decision about the release of the information. A senior lawyer at the Aarhus Centre for citizen involvement based at ClientEarth has made a positive referral to the lawyer who currently represents Pesticide Action Network Europe and Greenpeace Netherlands in a similar case which the EU Commission has appealed before the EU Court of Justice, regarding data on glyphosate. PAN and GP won the case in first instance. According to this General Court, parts of the glyphosate EU risk assessment (on by-products and contaminants in technical glyphosate) qualify as information on emissions into the environment under the Aarhus Convention. Thus, assuming the first case is upheld, the new case, if also favourably-decided may make essentially all information in a risk assessment public (allowing independent scientists to analyze & critique key data); in addition to opening up the RA of the world’s most popular pesticide. Both lawyers are distinctly hopeful about the chances of this new case, though a negative opinion can of course occur.
