Those of you who have HMOs where you bring in a regular cleaner and/or gardener, what kind of setup do you have with them? Are they considered to be employed by you, or self-employed? Ive been looking at HMRCs employment status indicator (hmrc.gov.uk/calcs/esi.htm) and it seems that its quite difficult to use a one-man band and tell them what you want them to do without being classed as their employer. In order for them to not be an employee it seems they need to have an existing business setup with numerous clients, provide their own materials and be responsible for supplying and paying a replacement if they are unable to do the job themselves for any reason, and decide for themselves how the job should be done. How much extra hassle does it entail if you *employ* a cleaner/gardener as opposed to engaging a contractor (asking as someone whos never been an employer before)?
