Three days ago a toddler aged 3 Ryan Ssemaganda was run over by a Kampala Capital City Authority (KCCA) vehicle being driven by a one Baguma. In the awake of events, Ms. Jennifer Musisi made a public apology regretting the events and also made a contribution of 2 million UGH cash, a bag of rice and sugar to assist in burial arrangements. This is my legal opinion and how the opposition, the police and some members of public are getting it wrong. The loss by Ryans family is selfishly being capitalized on by the opposition. This is not right. Legal Issues: 1.Whether there is any course of action that can be taken by Ryans family? The answer is YES and death unlawful death can be and is the course of action 2. Which parties to sue? KCCA and Baguma the drive. (civil and criminal liabilities) 3. What is implication of Jennifer Musisis contribution? Nothing! The family should treat this as MABUGO. Any person can show empathy to a family for loss of a loved one. She expressly noted it was personal money not from KCCA. 4. What remedies available? Damages from KCCA and Baguma the driver should do some prison time. 5. What is the role of the police in the matter? Not to divert themselves in attacking the opposition but, rather limit their work to investigation ( securing an autopsy and co-operating with Ryans family to ensure they get justice.
