To: The Premiers Office 204-450 Broadway Ave. Winnipeg, Manitoba Canada, R3C OV8 Tel: 204-945-3714 Fax: 204-949-1484 E-mail: [email protected] Attention: The Honorable Premier Greg Selinger I believe for many Manitobans the time has come for The Workers Compensation Board, Act, Regulations and Policies to be thoroughly reviewed and revised in the best interests of all Manitobans. As part of governmental due diligence, Governments on an ongoing basis need to review, modify and improve various laws, regulations and policies. Such actions are most important when there are ongoing contentious and systemic problems with the interpretation, application, and implementation of a particular law, regulation or policy such as the Workers’ Compensation Act of Manitoba. That being said, I am requesting that you direct your Government to promptly take this opportunity to create fair, humane and positive reforms for all Manitobans, in relation to the Workers Compensation Board of Manitoba. Not only does your Government have the mandate and power to create the urgently needed reforms within the Workers Compensation Board and Act, but as stated in section 115(1) of the Act, it has a legal obligation to undertake a comprehensive review. I suggest starting with the elimination of the systemic unreasonable, and seemingly indiscriminate practice of claim suppression through the use of the four Ds: Delay, Deny, Discredit and Disentitle. The Workers Compensation Board’s ongoing practice of delaying and denying benefits to a very high number of injured workers/claimants causes added and unnecessary family hardship and poverty, further overburdening our already overtaxed social safety nets and programs. I believe the time has come for our Government to direct The Workers Compensation Board of Manitoba to stop mismanaging valuable resources by knowingly and wrongfully allowing these discriminatory and inhumane practices, which contribute to Manitobas poverty level and generate further dependency on Manitoba’s other social safety nets and programs. The Workers’ Compensation Board, as per its name, was essentially created and exists primarily to compensate injured workers. It therefore follows that workers should have a say in its implementation and operation. Accordingly, the government must establish a legally constituted body representing the workers of Manitoba and establish its mandate in consultation with workers. Thank you in advance for your time and personal attention to promptly address and rectify the many contentious issues related to the Workers Compensation Board of Manitoba.
