UPDATE ON TVM AND ACTOS BLADDER CANCER CLAIMS: 1. Recent Jury verdict in Dallas, Texas on J & J mesh claim. The plaintiff was victorious with a sound verdict against J & J in favor of the plaintiff for $1.2M. Great victory since the J & J mesh device is still on the market. 2. In a recent Actos Bladder Cancer case, a jury returned a massive verdict in favor of the plaintiff who contracted bladder cancer after taking the diabetic drug ACTOS for four years. This is the case where I predicted that the jury would not like the fact that Takeda (Asias largest pharma company and E. I. Lilly accidentally lost important documents related to executive conversations and research pertaining to ACTOS causing bladder cancer). My prediction came true when the jury compensated the victim for $1.5M. The jury also, however, took only 45 minutes to send a message to the two mfgs. and other large multinational corporations that like to hide or ditch important documents that might effect the health of millions of people by slamming the multi-nationals with punitive damages with a staggering $9BILLION. Obviously the message was received loudly and clearly. Now the truth of the matter is that $9BILLION will not be paid. The case will go on appeal and the amount will be reduced dramatically. Certainly this case will resolve with a confidential settlement. BOTTOM LINE IS THAT THE BEHAVIOUR THAT WAS ON DISPLAY IN THIS CASE IS PRESENT IN MOST ALL MASS TORT CLAIMS. 9 TIMES OUT OF 10 THE PLAINTIFF ATTORNEYS WILL FIND A SMOKING GUN! IN THS CASE THE GUN WAS SMOKING AND FULLY LOADED AND THE DRUG COMPANIES DIDNT SEEM TO CARE. I BET THEY CARE NOW!!!!!!!!!!
