UPDATE. We today received a response from the Commissioner of Police, the following is the full content of the Commissioners letter Dear Sir I acknowledge receipt of your letter of 2014-01-13 and wish to advise that i was informed of the assault at Timehri and as a result the person who contacted me was referred to Commander A Division for an investigation to be conducted, which i was informed had commenced. In light of the matter being aired via the media, this matter was checked and so far the investigation is incomplete. Thus i have directed that the Office of Professional Responsibility take over the investigation. The ranks at Timehri Police Station will be replaced pending the completion of the investigation. I must further mention that in our document you indicated that an Attorney acting on my behalf was prepared to pay a sum of five hundred thousand dollars ($500,000.00) as compensation, i should let you know that I am not aware of that statement. Finally, we should let good sense prevail as the matter is being investigated and legal advice obtained. Yours in service Leroy Brumell DSM For your benefit i am including below an extract from the judgment of the Honourable Justice William Ramlal in the matter of Navindra Singh V Police Constable Benjamen 11712, Police Sergeant James 12496 and the Attorney General action 602 W of 2006who at page 6 where Justice Ramlal said In fairness to Counsel for the defendants, I should record herein that Counsel for the defendants did inform the Court that attempts were made by the Honourable Attorney General and counsel for the plaintiff to have this matter settled prior to commencement of the trial and during the trial. Unfortunately this did not bear fruit as Counsel for the plaintiff rejected the offer to settle for $500000.00 on the ground that the sum was exceedingly low. According to Counsel for the defendant only quantum was being contested.
