Unbelievable but...Aurora Public Schools grades 6-12 go back to school tomorrow?!? The city of Aurora is considering a photo radar van strictly for school zones. Were asking if the decision is going to be based on revenue or safety. While researching this story, we also found interesting info in the state law on photo radar vans. State law requires that you first receive a warning if youre caught going 1-9 mph over the speed limit... before youre eligible for a photo radar ticket. If youre caught going 10 mph or more over the speed limit, police are free to issue the ticket. If Aurora allows photo radar in school zones, the city attorney recommends not ticketing unless the driver is caught going 12 mph or more, so that he can prove beyond a reasonable doubt in court that the driver committed the violation. In his eyes, 11 mph is grounds to argue that calibration is off, opening the possibility the ticket gets thrown out.
