Here’s the scoop: Since September, the Koshak family has endured a nightmare. Their property in OC’s unincorporated Orange Park Acres (10675 S. Orange Park Blvd.) has been first taken from them in an illegal seizure and then two crooked lawyers – Philip Green and Jennifer Needs – have been locked in a battle to further steal the Koshak’s precious possessions. Through clandestine maneuvering and aided by the Orange County Sheriff’s department, the Koshak’s $2.4 mllion property has been locked up and the family has been barred from entering even though the Koshaks have lawful protection under California’s bankruptcy laws. Yesterday, on Nov. 4, Needs showed up yet again and spent the day at the Koshak house in an attempt to rob them of their possessions, which they themselves had to buy back for $3,100 and for which they have seven days to take away peacefully from their own property. The footage from yesterday’s attempted robbery can be viewed on the Koshak House Ustream channel here: ustream.tv/channel/koshak-house On Oct. 28, the two attorneys Philip Green and Jenifer Needs showed up to have an auction of the Koshaks furniture, home contents, and personal things such as their son’s many trophies and ribbons. However, under the Fourth Amendment, this was an unlawful seizure. In any such seizure, items must be inventoried and given to law enforcement officials (if the seized contents are not claimed then a copy of the inventory is typically sent to the State Department of Revenue and the IRS as it is considered assets and taxed). Can you imagine two lawyers, an auctioneer and two “buyers” just showing up at your property out of the blue and you have to buy your own keepsakes back from them? Here is son Nathan Koshak’s testimonial from the unlawful Oct. 28 seizure: “It started with a car showing up at around 10 a.m. and parking in our driveway. I walked out to ask them what was going on and they said they were the representative of the company and they were waiting there for the attorneys. He said his name was Yihao. I asked him if our attorney was notified and coming up as well and he didnt respond. I sent a message to (our lawyer, Lenore Albert, at this point and got a hold of my dad. After that a large unmarked moving van rolled up the driveway and parked. Two women got out who havent revealed their identities. They walked over to the gate and looked at the property. These were the only buyers that were invited. I walked over to stand by the gate while waiting for everyone to get here. After that, the auctioneer and the attorneys Jennifer Needs and Philip Green walked up and talked to everyone and asked for me to step aside because they were going to auction off the property. I asked if they were going to wait for Lenore Albert as shes on the way. They said that I was trespassing and I wasnt allowed to record them. If I didnt stop they were going to call the Sheriff’s Department to arrest me. I said Okay. So they made a long call a specific department at the OC Sheriff. Dad got there before the sheriffs and we waited in front of the house. Half a dozen Sheriffs rolled up the driveway in three patrol cars and two SUVs a moment later. At this point my dad called the fire departments hazardous materials division and they sent up a guy to write a report while the attorneys fumble with trying to open up their locks, eventually resorting to calling a locksmith to get the place open. My dad went around and got all the sheriffs identification info. Green announced that the public auction was starting so we began to head into the house after them. The Sheriffs did not stop us. The mediator representing the companys interest stopped us at the gate and said we were not welcome. We asked him if it was a public auction, he said yes. So we walked around him and entered the property. At this time the attorneys, the mediator, the buyers and myself went around the house looking at everything. I noticed that someone had knocked over our ammo safe in the garage and all the contents were strewn all over the ground. The auction started and to join you had to pay a $500 deposit in cash. I didnt see the other buyer pay, but my dad presented the cash to the auctioneer. They said that all the personal belongings on the property were being sold in one batch except for the contents in the gun safe in the garage. Meaning that they were selling the hazardous materials in the bid, too without letting the buyers know. The bidding started at $500 dollars and didnt end till my father won at $3,100 dollars. They demanded he pay them in cash, which he did. He handed the cash to the auctioneer and got a receipt from her. He asked the auctioneer for her license number and she said she didnt have it. The auctioneer then handed the money off to Jennifer Needs. I did not see if my father got his $500 deposit back. At this point, Sheri walked in and told us Lenore was here and everyone was getting ready to leave. We were told we had seven days to get what we bought out of the house and we had to make an appointment with Neil Leventhal to do it. The two ladies in the moving truck left, the auctioneer left and Needs, Green and Yihao discussed things over for a few minutes. Needs shooed us away saying this was a confidential meeting with a client. They then got into their cars and left. How can you help the Koshaks get justice? If you can show up to their home today to show support, please do so. The Koshaks need all the support they can get today from peaceful, loving people who are outraged at this injustice. The Koshaks have been threatened by Needs and the OC Sheriff’s Department to stop filming. This is illegal. They have the right to film whatever they desire. The OC Sheriff’s Department is not responding to our demand to allow them to film these criminal actions so they have video evidence.
