What are the texting & driving laws in Arkansas? Texting and driving is illegal and is also a primary offense. A primary offense means an officer can stop you for texting, without witnessing any other violations. Texting and driving is known legally as wireless interactive communication which means typing, text messaging, emailing, or accessing information on the Internet with a handheld wireless telephone while operating a motor vehicle. Here are a couple other lesser known laws in Arkansas concerning texting; 1. Drivers under the age of 18 cant use a wireless telephone while driving, period! No texting, no talking, not anything. 2. Drivers aged 18-20 can use a wireless phone to talk, but it must be a hands-free device. 3. Drivers cannot talk on their cell phones while driving through school zones or highway work zones.
