Winners of The Litigation Hypocrisy Hall of Fame. Hypocrisy is defined as “the practice of claiming to have moral standards or beliefs to which ones own behavior does not conform.” This topic is particularly apt for big business and special interest groups who enjoy blaming nearly everything on trial lawyers who fight for individuals. What is amazing is the companies that profess too many lawsuits are “the problem” are the biggest hypocrites. Our first winner is pharmaceutical giant Johnson & Johnson. Johnson & Johnson has had representatives on the U.S. Chamber’s Institute for Legal Reform (ILR)board, has co-chaired the corporate-backed Civil Justice Reform Group steering committee, and has funded the American Legislative Exchange Council (ALEC), which exists to push state laws favorable to corporations. Still, Johnson & Johnson did not hesitate to use the civil justice system when it sued (wait for it) the RED CROSS!! Johnson & Johnson objected to the charity’s use of a red cross symbol and sought not only the destruction of first-aid kits but also punitive damages and payment for its own legal fees. The American Red Cross called Johnson & Johnson’s actions “obscene.” Johnson & Johnson lost their bid. It would seem that frivolous lawsuits do, in fact, exist – But it is the large corporations that are the one’s filing them.
