Wintrow case appeal goes to special prosecutors Patrick McGail is fighting murder conviction in 2013 Miami County case. By Nancy Bowman, DDN Contributing Writer TROY, Oh. --- (January 9, 2015) Prosecutors from Clark County have been appointed to represent the state in Patrick McGail’s appeal of his conviction and sentence in Miami County in the 2013 murder of Nathan Wintrow, of Troy. McGail, also of Troy, was convicted by a jury in August and sentenced in October to 24 years to life in prison. His lawyer, Christopher Bucio of Troy, filed an appeal with Ohio’s 2nd District Court of Appeals. The request for special prosecutors was filed Thursday, Jan. 8, in Miami County Common Pleas Court. In the request for an appointment, Miami County Prosecutor Tony Kendell cited a conflict of interest because of pending civil litigation against him by Bucio. Bucio sued Kendell following a search of Bucio’s law offices in Troy, Sidney and Tipp City in September as part of a criminal investigation involving the McGail case. Miami County Judge Christopher Gee approved the appointments of D. Andrew Wilson and Ryan A. Saunders as special prosecutors. Wilson is Clark County prosecutor and Saunders is an assistant Clark County prosecutor.
