Yesterday I received a legal demand notice dated 15/11/2013 from a Queensland Government Department called SPER threatening court action and suspension of my NSW licence. In September 2011, a car I bought in December 2011 received a parking violation on the Gold Coast. The original notice left on the windscreen wasn’t received by the owner of the car at the time, so therefore wasn’t paid in the original time frame. The Gold Coast City Council did a registration search in March 2012 and I came up as the current owner (obviously) so I got sent the one and only reminder notice. I contacted the council, and followed their procedure of lodging an appeal in writing by registered mail, accompanied by a stat declaration and the details of the owner at the time of the infringement. I went one further, as the previous owner was my oldest son, I ensured the bill was paid. I then rang SPER and they said contact the council it is out of their hands they are just a government debt collection agency. I then contacted the council who said, they had a record of contact from me, but couldn’t find the paperwork I sent through. I would have to do it all again by 2/12/13 or the threatened action would be enforced. I asked why I had received nothing from them for almost 18 months and they said…… they don’t even have to send the first reminder (April 2012), and they don’t have to chase it up, so they don’t. If it isn’t paid within 12 months they just take legal action. Now that it is over 12 months since my initial contact and letter I have to deal with SPER and I AM NOT IMPRESSED because someone else didn’t do their job. A registered letter has to be signed for….but they claim the responsibility of clearing my name is mine, to recontact them when I have the information together. This was a NSW registered car before and after I bought it. Beware of buying a car if it has ever travelled to QLD because you are guilty of what the previous owner incurred until YOU can prove otherwise.
