এইবারের স্বাধীনতার লড়াই আইনের লড়াই পার্বত্য চট্টগ্রাম দ্বন্দ্বে জড়িত পক্ষগুলোর (জুম্ম আদিবাসী এবং ঔপনিবেশিক শক্তি বাংলাদেশ) মধ্যে যে পক্ষ বেআইনি অবস্থানে আছে, সে পক্ষই হোল প্রকৃত দুর্বল পক্ষ এবং সে পক্ষই পরিশেষে হেরে যাবে এবং যেতে বাধ্য, যদি আমরা এই আইনগত শক্তিকে সঠিকভাবে ব্যাবহার করতে পারি। জনসংখ্যা বা সামরিক শক্তি দিয়ে এখনকার যুগে পৃথিবীতে আর কোন যুদ্ধ জয় করা যায়না--একমাত্র পরা শক্তি আমেরিকার ক্ষেত্রে এটা অনেক সময় ব্যতিক্রম হতে পারে। সুতরাং এই বারের পার্বত্য চট্টগ্রাম স্বাধীনতার লড়াই হবে আইনের লড়াই। এই লড়াইয়ে বাংলাদেশের স্থল-নৌ-বিমান বাহিনী, মিশাইল বা ড্রনের কোন ভূমিকাই নেই। আন্তর্জাতিক মানবাধিকার এবং আদিবাসী সংক্রান্ত আইন অনুসারে বাংলাদেশ পার্বত্য চট্টগ্রাম দ্বন্দ্বে এক চরম বেআইনি অবস্থানে আছে। নীচে দেখুনঃ বাংলাদেশের ঔপনিবেশিক শাসন এবং শোষণের জাঁতাকলে বসবাস করছি বলেই আমরা--পার্বত্য চট্টগ্রামের জুম্ম জনগোষ্ঠীরা-- নিজেদেরকে "আদিবাসী" (indigenous people) বলি। বাংলাদেশ আমাদেরকে "উপজাতি" (tribe) হিসেবে চিহ্নিত করে। এর কারন--আন্তর্জাতিক আইনানুসারে (international law) একটা আদিবাসী--যেমন জুম্ম--আত্মনিয়ন্ত্রণ অধিকার নীতির (principle of right to self-determination) ভিত্তিতে তার ঔপনিবেশিক শাসকের (colonial ruler)--যেমন বাংলাদেশ--শাসন শৃঙ্খল থেকে মুক্ত হয়ে স্বাধীন জাতি বা রাষ্ট্র বা দেশ (independent sovereign state) হিসেবে আত্মপ্রকাশ করতে পারে বা স্বাধীন জাতি হিসেবে আত্মপ্রকাশ করার অধিকার দাবী করতে পারে। যেমন ইস্ট তিমর ইন্দোনেশিয়া থেকে বিচ্ছিন্ন হয়ে একটা স্বাধীন জাতি হিসেবে আত্মপ্রকাশ করেছে। আন্তর্জাতিক আইনানুসারে একটা "উপজাতি" বা "সংখ্যালগু সম্প্রদায়" (minority) বা "ক্ষুদ্র নৃগোষ্ঠী" (small ethnic group) এই দাবী করতে পারেনা। এই জন্যই বাংলাদেশ সুকৌশলে ইচ্ছাকৃতভাবে আমাদেরকে "উপজাতি" -- আজকাল "উপজাতিও" নয় -- "ক্ষুদ্র নৃগোষ্ঠী" -- হিসেবে চিহ্নিত করে। অর্থাৎ বাংলাদেশ আমাদের স্বাধীন জাতি হিসেবে আত্মপ্রকাশ করার আধিকারকে অস্বীকার করে। এই জন্য সে জাতিসঙ্ঘে (United Nations) গিয়ে বিভিন্ন বিভ্রান্তকর বিবৃতি দিয়ে বলে, "বাংলাদেশে কোন আদিবাসী নেই"! এটা হোল আমাদের আত্মনিয়ন্ত্রণ অধিকারকে পদলিত করার জন্য তার কূটনৈতিক চাল এবং অপপ্রচার। এই জন্য জাতিসঙ্ঘ "আদিবাসী সংজ্ঞা " নিয়ে বাংলাদেশ যে চালাকি করছে তা তীব্র নিন্দা জানাই ( বাংলাদেশঃ মানবাধিকার পেরিওদিক রিভিউ ২০১২)...পার্বত্য চট্টগ্রাম একটা স্বাধীন দেশ ছিল। ১২০০ থেকে ১৭৫৭ (পলাশীর যুদ্ধ) পয্যন্ত অবিভক্ত ভারতবর্ষের কিছু অনেক অঞ্চল যেমন পার্বত্য চট্টগ্রাম মুসলিম শাসনের বাহিরে ছিল। এর মূল কারন প্রাকৃতিক প্রতিকুলতা। ব্রিটিশরা পরবর্তীতে ১৮৬০ সালে এই অঞ্চলকে চট্টগ্রামের সঙ্গে জড়িয়ে দেন (cht24/পার্বত্য-চট্টগ্রাম-মোঘল/#.UZ8OLsu6ZLO)। আমাদের পার্বত্য চট্টগ্রাম ঐতিহাসিকভাবে এবং আইনানুসারে একটা স্বাধীন রাষ্ট্র (যদিও আধুনিক "রাষ্ট্র" অর্থে নয়) ছিল । ব্রিটিশরা ভুল করে জবরদোস্তি এবং বেআইনিভাবে পার্বত্য চট্টগ্রামকে তদানীন্তন ইস্ট পাকিস্তানে (বর্তমান বাংলাদেশে) ১৯৪৭ সালে সংযুক্ত করে দেওয়ার ফলে আমরা আমাদের স্বাধীনতা হারিয়ে ফেলেছি। আমরা এখন বাংলাদেশে একটা "আদিবাসী"--"উপজাতি" নয়। আমরা ইস্ট তিমরের মতো আন্তর্জাতিক আইনানুসারে বাংলাদেশর ঔপনিবেশিক শাসন ও শোষণ থেকে মুক্ত হয়ে আমাদের আত্মনিয়ন্ত্রণ অধিকারের ভিত্তিতে একটা স্বাধীন জাতি হিসেবে আত্মপ্রকাশ করবো। এই জন্য decolonization of CHT and self-determination of the Jumma indigenous people--এই আন্দোলনটা আমাদের করতে হবে আন্তর্জাতিক প্রচার এবং কৌশলগত সংগ্রামের মাধ্যমে। আমরা ইতমধ্যেই এই কাজ শুরু করে দিয়েছি। আপনারাও, বিশেষকরে জুম্ম তরুণ-তরুণীরা, সবাই এই আন্দোলনে যোগ দিন। এটা আমাদের দরকার আছে। কারন আমরা জুম্মরা বাংলাদেশের মতো উগ্র ইসলামিক মৌলবাদী দেশে নিজের জাতীয় অস্তিত্ব বজায় রেখে সুখে-শান্তিতে থাকতে পারবোনা। আমাদের শান্তি, নিরাপত্তা এবং উন্নয়নের জন্য পার্বত্য চট্টগ্রামকে বাংলাদেশের ঔপনিবেশিক শাসন ও শোষণ থেকে মুক্ত ও স্বাধীন করতে হবে এবং এটা জাতিসঙ্ঘের চার্টারের ধারা ১ (২) এবং জাতিসঙ্ঘের সাধারন সভা দ্বারা ১৩ই সেপ্টেম্বর ২০০৭ সালে গৃহীত আইনের ধারা ৩ এবং নম্বর ৬১/২৯৫ আওতায় সম্ভব। CHT WILL BE AN INDEPENDENT AND SOVEREIGN NATION LIKE EAST TIMOR The Jumma is an indigenous people, NOT a "tribe" NOR a "small ethnic group". They identify themselves as an “indigenous people” in the context of the history of colonial rule in their traditional homeland. Bangladesh illegitimately tries to identify them as a "tribe" or a "small ethnic group" nowadays as part of its policy/conspiracy to undermine their inalienable right to self-determination (= independence). CHT, the traditional homeland of the Jumma indigenous people, has been occupied and colonized by the three successive colonial powers -- British, Pakistan and Bangladesh. If Bangladesh MISHANDLES the CHT issue, the Jumma indigenous people will be free of all colonial powers, including Bangladesh, and emerge as an independent and sovereign nation, like East Timor and South Sudan. Mishandling means denial of autonomy to them. Autonomy is the key to the protection and promotion of their distinct identity (land and resources, history, language, literature, religion, culture, way of life and all institutions -- political, economic, social and cultural -- developed or developing on the basis of these). We, the Jumma people, will just follow the East Timorese, that is, we will call for an UN intervention for a referendum in CHT, that is, a free, fair and independent referendum will be held under UN observers and peace-keeping force; in that referendum Jummas will given two options for vote: (1) autonomy within Bangladesh and (2) independence from Bangladesh. We, Jummas, will vote for (2). This is POSSIBLE as per international/UN law--as per the Article 1 (2) of the UN Charter and the Article 3 of the Resolution No. 61/295 adopted by the UN General Assembly on 13 September 2007 in New York. WAY TO FREEDOM: DECOLONIZATION OF CHT AND SELF-DETERMINATION OF THE JUMMA PEOPLE Freedom can be achieved through two means: (1) war till death or defeat of the enemy and (2) war> international pressure> international law (Article 1 (2) of the UN Charter and the Article 3 of the Resolution No. 61/295 adopted by the UN General Assembly on 13 September 2007 in New York). Bangladesh achieved freedom through the first means and The East Timor did through the second means. LTTE tried to achieve it through the first means. It was about to be successful but… Given our geo-political position and strength, we, the Jumma people, have no other realistic means but the second one. If we successfully go through the second means, a situation will arise when our enemy will have no option but to accede to a referendum in CHT under the UN intervention. In this referendum the Jumma people will be given two options for vote: (1) autonomy within Bangladesh or (2) independence from Bangladesh. We, Jummas, will vote for (2). This is POSSIBLE as per international/UN law mentioned above. Its example is The East Timor or South Sudan. The spirit of our movement stated above is not a figment of imagination. It is based on the history of colonial rule in CHT and the legitimate aspiration of the Jumma people of CHT. We struggle not for money and power but for the freedom of the Jumma people of CHT.
