Regarding Law and Judicature Parliamentary standing committee— Rule of law Humanitarian grounds Up hold actions Bold gold mounds 1]- ……………………Judiciary of 2015 decade……………………… ……………………. National Judicial administration system---- ……….. Hierarchy--------------- Chief justice--------- supreme court at Dehi. I Chief justice --- High court at state I District judge ---- district court at revenue District. ………………………..National judicial administration authority------------ 1]- Chief justice----- supreme court I--Justice 2]- Chief justice ----- High court I--Justice 3]- District judge ----- District court I- Judge- Magistrates- judicial and executive etc. All chief Justice of the HC / SC are to be filled by National commission ie the chief secretary of the central or state government as per the administrative formality code. Hnce all the other cadre in the cadre should be by the IJS exams in English language only. --------------------------------Single window judicial system………. The civil, criminal, ACB, CBCID, SBCID, Family, labour, bench, tribunal etc. are in single window. For the criminal case death warrant cases may be for President’s nod. The remaining cases are not needed the stay orders from higher courts. The appeal may be allowed . By his the cases pending was curtailed. Because the 2004 year Bombay blast case’s court order was implemented by 2012 year., even though the case was on special court on this deal The same was in Rajiv’s murder case. The judges for District court, labour court, family court, CID tribunals etc. In all Court’s Administration clerical staff, the educational qualification for all jobs , the candidate must be a law graduate to get cost effective model . For all type of cases at the district court is implementable .No stay order should be allowed to issue to all case by the high, or supreme courts for the district orders. The Criminal cases of death penalty types— For death cases the president ok is needed. so up to that the cases may be allowed for appeal at higher courts by the petitioner.. All types case the court’s order of the accused punishment ie. Jail imprisonment or fine or both etc. is implementable up to Higher court’s judgement orders. The judicial authority should be under central list as the justice was not maintainable by the state governments as the justice was a national’s citizen issue ie irrespective of linguistic issue ie Hindi, Tamil, Kannada, Telugu etc.. Conclusion--- The above methods are implementable by all courts. Hence for a trial basis, this method nay be implemented in any one district court, on trial basis for 5 years time by he GOI as a UPSC model. Here by I am declaring that all above matter is true to the best of my knowledge and belief and submitting all necessary particulars with full address ID numbers and passport size photo of 2012th year. All is well that ends well Justice and Democracy Inter related / platted Inter pole 2]- National judicial commission- Indian Judicial service- Justice, Judge, Magistrate etc. appontment by GOI- Delay justice was a justice denied The court’s post ie. filing , registration, Bench court staff , senior advocate, Advocate general, Public prosecutor, Legal aid authority, Tribunal etc. Officer / Judge / Justice should be posted by NJC-IJS, for candidate who has a Law degree and registered in Bar council of India. In India the court posts are at Supreme court = 300, at the high court = 29 x 200 = 6000 say, at district court = 400 x 100 = 40000, Taluq court = 5000 x 5 = 25000, tribunals- administrative, labour, ACB, CID, commissions, committees etc. was about 1000 etc. numbers say. Hence the total number at the court’s vacancies will be in India was 72000 + ie. to be filled / posted by NJC as a IJS which was there as in UPSC, ECOI, NAS etc. These are all autonomous bodies. The Judicial service should be a autonomous body under chairman ship of NJC which has members of Chief justice of SC, Lok sabha’s speaker, Opposition political party MP leader of Lok sabha and Rajya sabha, PTI, PCI , public / private university Vice Chancellor etc. The vacant posts at the court are to be filled by NJC in every 1st day of January by the exams / tests which are as conducted by UPSC-GOI. The court’s vacant posts ie. in all Indian courts, that are should be advertised in the News dailies in the every 1st day of October month of in every year. For all posts in the court there should be minimum starting salary per month rs 10000/ for BC staff and rs 30000/ for justice / judge / magistrate / chairman and for chief justice rs 50000/ The court / judicial wage board for court’s staff / officer / justice / judges / magistrate etc is to be formed / framed by the GOI / standing committee of parliament ,to fix the annual increments, Basic scale pay as in the NAS, ie. to the Judicial service workers / officer / dignitaries 3]- Judicature Administrative reforms Act- Process and sessions ……………………….Sessions / process— A model sanctity.---------------- Daily case / cause list, motion list… at Bench court The court’s sessions should be under one chair at BC ie. …………………………Day Case / Cause’s list………………… A]- type—time consuming types say for Admissions , Interlocutory, Hearing, With drawl, Dismissal, Arguments, Specially mentioned, Appearance, Counter, Report submission, Being mentioned etc, B]- Type--for Judgement, Orders, Hearing etc at final By this the time consuming at the item [A] type the case list number will be checked and filed ie. 500+ number of cases / causes can be posted and allowed for process by the BC justice / judge This method is to speed up the Judgement / Orders cases of [B] type. Because now at present the 90% sessions time at BC was consumed by Justice / judge / magistrate on [A] type cause day list. By division of cause / case to single window justice / judge / magistrate of judicial service the pending cases / causes list will be effectively disposed at the court of all criminal / civil types ie. for [B]- type lists on daily 20 + cases/ causes will be disposed / cleared for judgement / orders by single Justice/ Judge/ Magistrate. The national judicial commission is to be passed the above work as a rule in the form of ACT for speedy justice on single window sessions / process at all type of cases / causes in courts as per the NJC / IJS implementation works. For Eg. Case—at hcofap-500066—trial basis model— Administrative reforms ACT of 2014 on sessions / process on day Cause / Case lists of all types at the Bench Court of High Court of Andhra Pradesh / Telangana State – at Hyderabad- 500066………… The HC has 30 justice numbers BC ie. or each district one BC / Justice was allotted for day list cause / cases dealing. By this division of process work the Judgements, Orders, finals etc. causes issue of [B]-type the 10 out of 30 are to be posted for all types irrespective of matters and district, ie civil- criminal, service, non service etc. For [A] type the 20 numbers out of 30 BC Justices are to be placed ie .for type [A] cases say admission, withdrawl etc. irrespective of district and of matter That is to say for [A]-type cases 66% + and for [B] type cases 34% and less of the BC allotted in total numbers in that court. At present sessions works the B]- type works are 10% only on total process time in a year ie 100 days say. The case / cause list was in pending for years together say 10+ years eg. 2000 year case of WP / WPMP/ EP / SA / CC / CRP of ID- services case / cause etc. . The main cause was this procedure made by Registrar / Advocates / Justices / additional Judges and court’s officers. Observation— For eg. ………at hcofapts the {A] type case the justice has 90% and for [B] type cases the justice has 10% time at the BC as the [A]-type cases / causes are entering 1000 + numbers WP per day at the hcofap/ts-500066. Hence the for Orders, for Judgement / orders / final hearing paid amount withdrawl etc. was only at 300~ say at all BC of hcofap/ts On a trial basis one year time may be taken trial at hcofapts for results and to implement at all High Court / District Court / Taluq Court in India. Source – data was from the web site http/hcofap.nic.in, case list information, SR/MP list, court wise list.Judicature information. The Government of India has to made a rule to conduct the court sa Orders, Final hearing, Judgement etc are should be in one judge / Justice. The remaining stages are should be with one Judge / Justice . That is to say the type cases division of number of cases A or B type should be with 50% of the total number of Justices / Judges at the High court say. Hence the A Type should be 50% and type B to the other 50 % justices / Judge at that court are to be allotted by the GOI. By this the Civil, Criminal, Service or non Service matters etc. can be disposed by the each BC was 100+ per day of Type B cases. Conclusion----- The type cases will be admitted 1000+ per day at the hcofap. Hence the case disposed by the hcofap at Hyderabad will be 150000 + cases per calendar year The cases are registering in the hcofap was 150000 + cases per year. A copy of the list was enclosed infavour of information on evidence proof on the court daily sessions / process reforms by the GOI .NIC-TAPHC- computer cell- registrar-hacofap/ts-w/s= http/hcofap.nic.in Because the state governments are ineffective / unable to handle the Indian citizen cases or causes of all types at the court as per present Collegium status of 2014 at the Judicature. Hence the solution for delay justice , the war / foot step action is to set up the Union Judicial Service Commission and Indian Judicial Service by / under GOI rule at the all areas of the Indian country as the Judiciary was a National subject on Natural justice of law / practice.
