(332) 2. EU as a regulatory state. Regulation is the key mode of governance in the European Union. Rules give member states and businesses a predictable foundation on which to base their transactions, while they are monitored by a “neutral referee” (i.e., the European Commission). Like any organization, however, the Commission has its own self-interest. Within the EU’s institutional setup, the Commission has very little power to demand additional financial resources, and even where it has appropriate funds, these remain largely connected to highly fixed schemes, for instance, the support of farmers through the Common Agricultural Policy. Given this lack of financial muscle to shape policies, the Commissioner has used regulation in an attempt to maximize its power.
