5150 in Hollywood. An involuntary psychiatric hold is actually a legal definition determined by probable cause. As a psychiatrist who places a patient on a hold, I actually have to present to an officer of the court reasons why I believe this patient is a danger to herself to others or gravely disabled. This officer decides whether my argument for continued treatment is justified or if the patient can be let go. I must present this evidence to the court within 72 hours of admission of the patient. For further treatment past this time, I again must present to the court probable cause for continuing treatment. As a treating physician I have to pay attention to these legal considerations regardless of my medical opinion about the patients care. I am not allowed by law to treat a person against their will.
