A First Information Report has been filed with the Anti-Corruption Branch (ACB) against the Speaker of the Goa Legislative Assembly Rajendra Arlekar in connection with the 500 sq mt plot at Porvorim bought by him for Rs 72 lakhs. The F.I.R has been filed under Sec 13 (1) (d) & (e) of the Prevention of Corruption Act 1988 and Section 120-B of IPC and/or Section 34 of IPC. The ACB has been given a copy of that sale deed dated 26th August last year where by Rajendra Arlekar had purchased from a Delhi based journalist Dharmanand Pandurang Kamat a 500 sq mt plot at Porvorim on payment of Rs 72 lakhs. Also given to the ACB is a copy of the affidavit filed by Rajendra Arlekar on 9th February 2012 in which he had shown his income for the year 2010-2011 as Rs 2,76,671 and that of his wife Anagha Deshpande Arlekar who is a school teacher as Rs 5,87,186. A perusal of the Sale deed and the Affidavit of assets and liabilities filed by Mr. Rajendra Arlekar clearly reveals that the purchase of this 500 sq mt plot at a whopping price of Rs 72 lakhs was clearly disproportionate to Rajendra Arlekar’s last known source of income. The sale deed does not reveal the mode of payment as to whether the amount paid by Rajendra Arlekar was in cash, cheque or draft. Mr. Rajendra Arlekar besides the 72 lakhs had also paid an amount of Rs 2,52,000 towards stamp duty and a further Rs 2,16,280 as registration and processing fees of that Sale deed. That Sale deed was executed before the Mapusa Sub- registrar in the presence of a Bharatiya Janata Party (BJP) office bearer from Merces Mr. Hemant Golatkar and another Merces resident Mr. Prasad Kamat as witnesses though they were fully aware that the Vendor of that plot, Dharmanand Pandurang Kamat was a permanent resident of Delhi and not Merces as falsely stated in the sale deed. In a recent judgment the Supreme Court Constitutional bench in the case of Lalita Kumari Versus Govt. of U.P. & Ors has clearly ruled that the police are duty bound to register an F.I.R if the same spells out a cognizable offence. Will the ACB act in accordance with the laid down law or act as caged parrots just because the complaint is against a powerful politician. We shall soon know.
