A Gatundu South voter has moved to the High Court Tuesday to challenge the election of the recently sworn in area MP Moses Kuria. The voter Patrick Michuki, said that in IEBC declaring Kuria as the winner of the August 7 by-election following the death of the immediate former MP Joseph Ngugi, had unproceedurally announced Kuria as the new legislator for the area. Michuki additionally said that the declaration was an infringement on the rights of the registered voters of Gatundu South to representation. Michuki further sued the IEBC for negligence and the manner in which the mini poll was organised. The voter further called on the court to freeze the assets of the Kuria who was a TNA political strategist prior to his election and have a financial audit conducted on him. Michuki farther faulted the Ethics and Anti Corruption Commission together with the IEBC on their silence over Kurias conduct prior to his election. The legislator had been summoned by the National Cohesion and Integration Commission for utterances that bordered on hate speech. Justice George Odunga who heard the application by Michuki directed the applicant and the respondents to appear in court on September 30 for further direction on the case. The IEBC declared Kuria as the new MP for Gatundu South after his only competitor Kiarie Kamere of New Democrats Party opted to step down from the race leaving Kuria as the sole candidate.
