A reply to Mr.Kishen Reddy B.J.Ps MLAs objection to 12% reservations to the economically backward Muslims...The concept of equality, enshrined in the Preamble has also found expression as a fundamental right in Article 14 to 16. Article 15(4) of the constitution of India states that: “Nothing in this Article shall prevent the State from making any provision for the reservation of appointments or posts in favour of any backward class or citizens, which, in the opinion of the State, is not adequately represented in the services under the State.” Reservation has also been extended to religious minorities. The Tamil Nadu government has allotted 3.5% of seats each to Muslims and Christians, thereby altering the OBC reservation to 23% from 30% (since it excludes persons belonging to Other Backward Castes who are either Muslims or Christians).[21] Kerala Public Service Commission has a quota of 12% for Muslims. Religious minority (Muslim or Christian) educational institutes also have 50% reservation for Muslim or Christian religions. The Central government has listed a number of Muslim communities as backward Muslims, making them eligible for reservation. I request shri Kishen Reddy to kindly go through the provisions of the constitution and then comment. I know that Mr.Kishen Reddy is a learned person and has been doing a great service to the constituents of his Assembly which has a substantial muslim population. He must have been misguided by some body and I am sure after going through the provisions made in the constitution and thereby amendments and the Presidential orders, he would make his stand clear.
