A ruling by the U.S. Court of Appeals for the District of Columbia could have a far reaching impact on the president’s Dream Act by executive order. The case was over the use of Yucca Mountain as a storage facility for used nuclear waste. President Obama has been stalling the construction and licensing of the facility. The judge ruled that the president cannot ignore laws passed by congress simply because he disagrees with the policy. That would effectively end his “Deferred Action for Childhood Arrivals” order. It could also affect the delays in Obamacare and force the president to allow the law to take effect on January first as planned, although the court could rule that implementation was impossible and therefore could be delayed. The court of appeals slapped down the president’s opposition to the Yucca Mountain facility by a 2-1 vote. The court issued a sharply worded decision accusing the NRC (Nuclear Regulatory Commission) of flagrantly flouting the law. They were allowing the Obama administration to close down the facility in opposition to a bill passed by congress...
