AND THE BEAT GOES ON ... I think Ombudsman Morales is right since there is yet no subpoena issued by the Senate for Napoles to appear before the Senate. It is therefore safe to say that there is no RIPE conflict yet IN LAW between the OMBUDSMAN and another co-equal body, the SENATE. Of course, the Senate , in aide of its power to legislate, may call upon Napoles to appear before it and it is not within the power of the OMBUDSMAN to refuse that injunction from the SENATE. What Ombudsman Morales gave is merely her opinion, pending issuance of a subpoena, for the untimely appearance of Napoles before the senate at this moment. Prudence demands from the OMBUDSMAN not to agree that Napoles appears before the Senate because there are still some members of the senate, who have not been indicted and who could possibly be indicted in connection with the on going investigation of the PDAF scam. With Napoles appearing before the senate , it is possible that she may untimely reveal or jeopardize the possible cases against these un-indicted senators. It may be possible that this is what Senator Drilon had found out and guided his refusal. FOR THE MOMENT,IT MAY BE A VERY UNPOPULAR POSITION , FOR BOTH, BUT IT IS THE RIGHT THING TO DO IN THE END, FOR PEOPLE AND COUNTRY. Meantime, until and unless the SENATE issues a subpoena for Napoles AND the OMBUDSMAN refuses to honor that subpoena, there is no conflict between the two.
