ANOTHER BLOW TO TAINTED POLITICIANS BY SUPREME COURT The apex court held yesterday that any person in jail or in police custody cannot contest the elections to legislative bodies. However, it is made clear that it would not apply to preventive detention under any law. According to the court, as per sections 4 & 5 of Representation of People Act, only an elector can contest the election. Section 62 of the Act provides that any person in jail or police custody cannot vote. Therefore, any person in jail or police custody cannot contest the election. This decision will have far reaching effect.
