AREGBESOLA ACCEPTED HIS FAITH! CLOSED HIS CASE BEFORE DUE DATE!! THE CLOUD IS NOW BRIGHT & CLEAR FOR IYIOLA OMISORE!!! Ogbeni Rauf Aregbesola the first respondent of All Progresseves Congress APC, in the ongoing August 09th, 2014 Osun State governorship election petition trial filled by Senator Iyiola Omisore closes his case at noon today, after calling only eighteen witnesses. Some of the witnesses called claimed to be members of the public while others claimed to be party agents of APC. Throughout their cross examination by counsels to Omisore they were able to affirm that the EC8A forms in their polling units were not stamped nor signed, while various discrepancies in the figures entered in their various units that were shown to them were also affirmed, but claimed to be the fault of INEC staff who input the figures in the form EC8A and others that was brought as exhibit before the court by the petitioner. In todays proceeding before the sudden announcement of the closure of their case,two witnesses were called by Ogbeni Rauf Aregbesola from ward 01 unit 01 Irepodun local Government and the other Aminullai Rafiu Ayodabo from ward 04 unit 009 Ede North local government of osun state. The two witnesses under cross examination by the counsel to first and second respondents affirmed that the election was peaceful and that the form EC8A were duly stamped and counter signed by INEC staff in their various polling units. But during cross examination by the lead counsel to the petitioner Senator Iyiola Omisore, Nathaniel Oke SAN. The two witnesses confirmed to the tribunal that the form EC8A shown to them from there units were not stamped with INEC stamp. It was also affirmed by Atanda Isaac from ward 01 unit 001 Irepodun local government that the differences in the figure recorded for voters which according to him is 251 as written in exhibit 197, which was at variance to the one recorded in exhibit 384 volume 1 page 6 where the total number of the recorded voters is 249. When Atanda was confronted by N O.O Oke SAN that he was not the one who signed his witness deposition and the form EC8A because they do not look alike. He said he was the one who signed the two. Oke then requested the leave of the court to allow Atanda sign three times, specimen of his signature, which he did. But N O O Oke SAN put it him that they were not the replica of what is on the deposition and the form EC8A. Learned SAN Oke then sought the leave of the court to tender Atandas specimen signature as exhibit, it was taken when there was no objections from the first, second and third respondents and was marked off exhibit 392. Atanda who told the court that he graduated from Federal Polytechnic Ede in 2008 and that he has started block making thereafter was shown exhibit 384 the voter register in which he said he voluntarily gave his particulars to INEC registration officer claimed in 2011 to be a student, while he has already told the court that he graduated and left school since 2008. ( three years after ) He also told the court that instead of the duplicate pink colour form EC8A that as APC agent was given the white Original of the form. Under Cross Examination by Nathaniel Oke SAN the first respondent witness of today Aminullai Rafiu Ayodabo from ward 04 unit 009 Ede North local Government, was asked whether another election aside the gubernatorial election was held on the 09th of August 2014, he said only the gubernatorial election took place. He was then shown the exhibit 275 in which he checked his name and face as it was ticked for him that he participated in presidential election instead of the gubernatorial and house assembly that are supposed to be marked for him. Though he said the fault and error was not from him but INEC official, the Senior Counsel to Senator Iyiola Omisore put it to him that the record have it that he did not participate in a gubernatorial election but presidential. Again he was asked to take a look at Exhibit 18E item 413 and 593 recorded as the total number of votes cast. He was also shown in Exhibit 194 where it was recorded that 411 is the number of total valid votes as against 413 which Nathaniel Oke SAN draws the attention of the tribunal to. It would be recalled outside the tribunal last week a lady witness who was being persuaded to give evidence in the proceeding refused and ran away from the court premises.
