If one looks at article 74, at the very end of the constitution, it provides for regulations of the party. The regulations provide for issues such as conditions for membership, termination of membership, readmission, discipline, expulsion after conviction etc. These are the regulations that are referred to. At best, the central committee can only initiate and/or approve matters under article 74. Constitutional provisions override regulations. Article 71 says amendment can only be through general conference. No question about it. Now, we hear the central committee has endorsed a particular candidate. It is cardinal to know what constitutes a central committee meeting. Articel 61 provides for the powers of the president. It says The president shall (A) be the principal spokesperson of the party on national and international affairs; (B)preside over meetings of the central committee. (C) convene meetings of the central committee. (J) take a decision or action which in his opinion is in the best interest of the party. Now, we are all agreed that in terms of article 54, the vice president takes over functions of president in the event of death of president. So, did the president convene the meetings for endorsement of a particular candidate? Did he preside over those meetings in terms of article 61? If he didnt, those meetings could be said to be null and void. Isnt he empowered by article 61 (j) to take any action which he feels is good for the party? Would going to general conference not be good for the party? That is his absolute discretion. Article 52 is clear that president shall be elected at general conference and person who wins such election will represent the party for election of party president. So where is Scott wrong?
