Bingham Wind Project Blue Sky West LLC and Blue Sky West II, LLC Dear Chair Foley, I am making this appeal to the Board of Environmental Protection on the Bingham Wind Permit . Petitioning against 5. NOISE (page 9 of Bingham Wind draft 2014) COMPLAINT RESPONSE “ F. Sound Complaint Response and Resolution Protocol. The applicants propose to implement a formal protocol for responding to sound complaints. The proposed protocol will meet all applicable standards of Chapter 375(10)(I)(7)(j). “ I object to this ruling and feel a complaint hotline should be in the hands of Local Health Officials at the expense of the developer. 1. Complaint is harm observed. “Every municipality/ town, is required, by law, to employ a Local Health Officer” Problem solver to resolve complaints. Investigate/Enforce complaints. Enforce public health safety laws. Keep record of complaints, investigation and resolution. 2. Easements acknowledge harm. CMW perpetuity easements hold CMW harmless to these harms. harm to include light pollution from turbine blade flicker and red flashing lights, audible wind turbulence noise levels, air turbulence, sound wave emissions (included but not limited to infrasound) disturbance or emanations of any kind of nature that are created in the ordinary course of operations of the Canton wind facility. They do not want diminished property value, Barnett said. 2.Licensee control of noise by purchasing noise easements . CMW permit 2014 page ten “demonstrate compliance” ….”acquisition of three more noise easements” 4.The developer and the DEP are not health experts. This objection goes above the simple 42 dba noise compliance. People with-in 2 miles of turbines report hearing the “sound of an airplane that never lands” for days. Folks with-in two miles of turbines report “infrasound” health disturbance. 5.A Local Health Officer can man the Hotline f or health complaints above and beyond the noise compliance rules. The law states it is mandatory every municipality employ a Local Health Officer. I request that the licensee install a health hotline in the municipal town office and pay the wages for the hours the LHO works on complaints. Google search show costs at about $70 installation fee and $15 monthly service fee. I have attended and submitted written comments about the Complaint Protocol at the Canton Mountain Wind DEP public meeting, March 22,2012, Bingham Wind DEP public meeting and again at a Canton Mountain Wind DEP public meeting July 24, 2013. I have been quoted by newspapers and published Letters to the Editors as stating the noise complaints are not being resolved.
