An Acknowledgement of Expert’s Duty Form has been incorporated into the Ontario Municipal Board’s (OMB) pre-hearing process since January 2010 when it came into effect under the Rules of Civil Procedure. The form is available on the OMB website. Effective September 3, pursuant to sections 38 and 91 of the Ontario Municipal Board Act and section 25.1 of the Statutory Powers and Procedure Act, the Board’s Rules of Practice and Procedure are amended to add a new rule setting out the obligations of an expert witness. The new Rule formalizes the existing practice and reflects the same policy direction as the Rules of Civil Procedure. The stakeholders are already familiar with the requirements and for that reason, no consultation period is provided.
