And thinking about prosecutions -- as a former Public Defender Ive always objected to the tendency of prosecutors to over charge -- primarily, I believe, to get guilty pleas on lesser charges. In order to prevent another financial meltdown Congress wrote and passed the Sarbanes-Oxley bill which, among other things, made it a felony to destroy, shred, etc. documents. The US Supreme Court is set to hear an appeal of a conviction for violating the felony of destroying, shredding.... documents by a fisherman who, evidently, threw overboard 3 undersized groupers. Instead of charging him with the misdemeanor of undersized catch, the Feds charged him with the felony from the Sarbanes-Oxley statute. What do YOU think the Supreme Court should do -- agree with the prosecution that Sarbanes-Oxley covers throwing under-sized fish overboard or declare it too fishy and not within the scope of the law?
