August 11, 2013 | Filed under: Breaking News | Posted by: + Nominations for Chipata, Malambo and Mulobezi constituencies may again not take place on Tuesday August 13, as barred candidates plan to get a court injunction. The electoral Commission of Zambia (ECZ) has announced that it will not accept nominations from former Petauke Member of Parliament Dora Siliya of MMD and UPND’s Maxwell Mwale of Malambo and Hastings Sililo of Mulobezi. The ECZ had postponed the nominations from last Friday to next Tuesday to sort out the confusion created by the ruling party PF which fears to face strong candidates. The ECZ said it had received a report from the High Court that the three seats were nullified due to electoral malpractice. The PF had wanted to ‘faka faka speed’ and force the ECZ to only accept nominations from the PF. But the Watchdog has been reliably informed that lawyers for the barred candidates plan to challenge the decision. The lawyers are said to be polishing the arguments this weekend and are expected to file the papers very early on Monday, August 12, 2013. The candidates through their lawyers will seek a court injunction to stop the filing in of nominations for the three seats until their grievances are heard and determined by the High Court. Among the arguments expected to be advanced is that at the time of the nomination day, last Friday, the ECZ did not have the report from the High court and therefore had no basis to bar them from filing in nominations.
