BEFORE EDWIN H. BENN ARBITRATOR ____________________________________ In the Matter of the Arbitration between STATE OF ILLINOIS, DEPT. OF HUMAN CASE NOS.: Arb. Ref. 10.251 SERVICES (CRA Dispute) and AFSCME COUNCIL 31 ____________________________________ SUPPLEMENTAL ORDER Upon presentation of the parties’ arguments and evidence, it is hereby found and ordered as a supplement to my April 4, 2012. Order: 1. The parties shall meet in the Labor Management process with the purpose of agreeing to procedures for maximizing the input and participation of bargaining unit employees in the transition process under the rebalancing initiative. 2. Any agreements reached as a result of the parties’ discussions shall be reduced to writing and signed by the parties. 3. Unless agreed otherwise, Murray Center Standard Operating Policy and Procedure 181 entitled “Community Discharge Procedure” shall be followed when transitioning individuals from Murray Developmental Center to another residence and the Director of Developmental Disabilities for the Department of Human Services shall issue direction that SOPP 181 be followed. In the event that AFSCME is of the opinion that SOPP 181 is not being followed, AFSCME DHS and AFSCME CRA Dispute shall bring that issue to the attention of the Director of Developmental Disabilities for DHS or CMS Labor Relations. 4. Unless agreed otherwise, the parties shall report on the status of their discussions no later than July 19, 2013. Upon reporting on status and in the event the parties are unable to reach agreement, this case shall be scheduled for hearing on an expedited basis on a date no later than August 15, 2013. 5. The undersigned will continue to retain jurisdiction to assure compliance with my April 4, 2012 Order and this Supplemental Order. Edwin H. Benn Arbitrator Dated: June 18, 2013
