BHARATIYA MUSLIM MAHIILA ANDOLAN [BMMA]. THE SECRETARIAT OF THE BMMA :- 35B, Royal Hill Society, NNP 1 & 2, New MHADA Colony, Goregoan [E], Mumbai – 400 063 Contact No: Noorjehan Safia Niaz – 09833072690/ 022-28407874 Blog: bmmaindia.blogspot.in R. JAIBUNNISA , Tamil Nadu - 09944137810 OBJECT OF BMMA :- LAW REFORM BMMA has also prepared a model Nikaahnama Mehr amounts in these marriages ranged from 5000 to 1 lakh. Many women got property and jewelry in the form of mehr. This nikaahnama forbids oral triple divorce by men. In case any of the parties need a divorce than a process of arbitration has to be initiated and only after due process can a divorce take place. A Muslim man cannot remarry while he is under this contract. The age of marriage is 18 for girls and 21 for boys. They have also taken legal remedies through Court of law and police. However, the Jamats expressed their inability to control men marrying more than one woman as “No Objection certificates” are taken from outside their villages. The important ones were that the practice of triple divorce should be declared void and that the jamaats should not accept it. It was also decided that women will be included in the jamaat to deal with cases of women who come there. The protest was against the triple talaq divorce – uttered by the husbands either orally or though Skype or Facebook, or even through SMS. LEGAL ACTION TO STOP QAZI FROM ISSUING TALAQ CERTIFICATES. Separately from the protest organized by BMMA, a legal suit has also been filed by Badar Sayeed, Advocate (the first woman to head the Wakf Board) and the Tamil Nadu Minorities Commission in Madras High Court. The suit seeks to stop Qazis from issuing Talaq Certificates. So is the triple talaq divorce valid? Islamic scholars differ. Some scholars say that the triple talaq should not be uttered all in one go. They point out that after each utterance of talaq, there should be a period of several months of waiting as families and communities try to effect reconciliation. The oral talaq is un-Islamic, inhuman and a violation of Quarnic injunctions. Men can get away with the triple talaq divorce because they get endorsement from the Qazis. Why can’t men get married over the telephone if they can divorce their wives over the phone. Why is India still allowing the triple talaq divorce when neighboring Pakistan and Bangladesh, along with at least half a dozen other Muslim countries have already banned it? No woman wants her husband to marry another woman. MEHR Many agreed to the mehr to be 100% of the man’s annual income. Some suggested 75% of his income. A few suggested 2/3 of his annual income. The suggestion about keeping the state minimum wages in mind while deciding the mehr was not welcome. MAINTENANCE It is the responsibility of the husband to maintain the wife and manage the household expenses, even if the wife has an independent source of income. The gathering also agreed that even if the wife has an independent source of income it is the responsibility of the husband to provide for her personal expenses DIVORCE Practise of halala has to be declared illegal and invalid Oral or written unilateral divorce is an invalid form of divorce Inheritance The value of the domestic work done by women must be counted in economic terms. A woman gives up her work outside, looses out on income and promotions, and sacrifices her career and economic independence for the family. Whatever a man earns in the married life is also because of the sacrifice and the unpaid, unrecognized contribution of his wife. And this contribution must be acknowledged by sharing the marital property equally. Compulsory registration of marriage with the state authorities. Mother and father both should be declared as natural guardians of the child while deciding its custody. The ‘best interest of the child’ should be the guiding principle while deciding custody of the children.
