BPL card holder will get information free of cost under RTI Act, 2005 direction by Hon’ble Odisha High Court on dated 03/07/13. In a landmark judgment Chief Justice of Odisha High Court Shri C. Nagappan and Justice Shri P. Mohanty in the writ petition under Articles 226 and 227 of the constitution of India vide case no. W.P.(C) No.4797 of 2013 has directed the public authority to supply information free of cost to the BPL applicants. Admittedly, proviso to sub section (5) of section-7 of the RTI Act, 2005 stipulates that no fee shall be charged from the persons who are of below poverty line (BPL). “The petitioner Shri Kunja Bihari Patra having filed his BPL card showing that he comes under the BPL category, no cost of information can be imposed on him”, the court directed. Hence, the order directed the PIO of Asst. Engineer of NH Sub-Division, Nayagarh to furnish information as sought for by the petitioner without deposit of any cost therefor. The State Information Commission is also the party to this case. The State Information Commission and the State Government should implement such significant order of the High Court for larger interest of citizen of India and in respect to the spirit of the law.
