BRIEF NOTE OF PROCEEDINGS BY H.S .PHOOLKA MISSING CHILDREN MATTER Supreme Court has summoned the Chief Secretaries of State of Karnataka and State of Tripura because they have not filed the Compliance Report. Hon’ble Chief Justice of India, Justice H.L. Dattu ordered that every week they will take up two states and will examine their performance in detail. So, today Mr. Phoolka Senior Advocate appearing for Bachpan Bachao Andolan handed over to the Hon’ble Court the chart pertaining to State of Bihar and State of Chhattisgarh. State of Bihar has not provided any data in its affidavit. State of Chhattisgarh has mentioned in its affidavit total number of missing children. Accordingly total number of missing children in State of Chhattisgarh are 9428 and 1977 FIR are registered. Mr. Phoolka argued that this is a clear violation of order of Supreme Court because in almost three-fourth of the cases even FIR is not registered. On this Supreme Court directed the Chief Secretaries as well as DGPs of State of Bihar and State of Chhattisgarh to appear before the Court on 30.10.2014. CJI, Justice H.L.Dattu mentioned that one woman came to him profusely crying that her child has gone missing and police is not taking any steps. Justice Dattu also mentioned that it is painful to see that everyday in the newspaper and television the reports of missing children are published and telecasted. Justice Dattu further observed that in the states where there are repeated complaints of missing children, the Supreme Court would summon the Chief Secretaries, DGP and would initiate proceedings of contempt of court against irresponsible officers. On the next date 30.10.2014 the Chief Secretaries of four states Karnataka, Andhra Pradesh, Bihar, and Chhattisgarh and also DGP of Bihar and Chhattisgarh would appear before the Hon’ble Court. The court would also examine performance of other states.
