Blade runner Oscar Pistorius has been found not guilty of premeditated murder and has been cleared of the murder of his girlfriend, Reeva Steenkamp, a vindication for the athlete who vehemently protested his innocence during a trial in South Africa that gripped millions around the world. I was attacked here when I said from the beginning he will be cleared of the murder! This is after I had seen how police messed up the case by contaminating the murder scene, compromising the evidence and deliberately trying hard to nail him down using screwed evidence. People should blame everything on the SA polices failure to investigate and handle the case in a professional way instead of cooking evidence, stage managing the whole process and relying on unreliable witnesses.There is much discussion online about the judge Thoko Masipas interpretation of dolus eventualis: whether, in firing four shots into the door, Pistorius should have foreseen the possibility that he would kill the person behind it. Masipa ruled that there was no evidence to show that he did kill Reeva willingly- which is correct. Culpable homicide in South Africa is defined as the ‘unlawful negligent killing of a human being’. It is a charge that focusses on negligence rather than intent. There is no prescribed sentence for culpable homicide and the judge can use her discretion in sentencing based on the circumstances of the case. People shouldnt be shocked if Pistorius is let off, fined, given community service or couple of months behind bars which l doubt. The judge simple used the evidence provided to weigh the options and found the defendant not guilty as charged but guilty for causing the death of a human being. So hands off the judge but blame it on the SA police!
