Burwell v. Hobby Lobby was only controversial because it involved coverage for contraception. If it had been a religious objection to a blood transfusion or vaccine, there would be no question that it was the wrong decision. The Court must have known that, because they included this near the end of the opinion: “[O]ur decision in these cases is concerned solely with the contraceptive mandate. Our decision should not be understood to hold that an insurance-coverage mandate must necessarily fall if it conflicts with an employer’s religious beliefs. Other coverage requirements, such as immunizations, may be supported by different interests (for example, the need to combat the spread of infectious diseases) and may involve different arguments about the least restrictive means of providing them.” There’s not a doubt in my mind that the Court was wrong today.
