CAT calls Amitabh’s transfer valid, dismisses petition The Lucknow bench of Central Administrative Tribunal (CAT) yesterday dismissed the petition filed by my husband Amitabh Thakur challenging his transfer from the post of IG Prosecution to IG Civil Defence. In the petition, he had alleged that he was transferred from Prosecution department against Rule 7 of the IPS Cadre Rules 1954 amended on 28 January 2014 which says that no transfer before two years can be made without adopting a definite procedure. Judicial member Navneet Kumar said in his order that transfer in relation to services only means a change of place of employment within the organization, which is an incident of public service and Courts do not interfere as long as there is no violation of law. CAT said that though Rules came into effect on 28 January but the State government came to know of this only through DOPT letter dated 14 February and hence there was no reason to interfere in the transfer.
