CIRCULAR The National Green Tribunal in the OA No. 21/2014 in the matter of Vardhaman Kaushik Vs. Union of India & Ors. In its order dated 26.11.2014 has passed the following directions;- 1. All vehicles, diesel or petrol, which are more than 15 years old shall not be permitted to ply on the roads and wherever the such vehicles of this age are noticed, the concerned authorities shall take appropriate steps in accordance with law including seizure of the vehicles in accordance with the provisions of the M.V. Act, 1988. 2. The vehicles which are more than 15 years old, will not be permitted to be parked in any public area and they shall be towed away and challaned by the police in accordance with law. This direction would be applicable to all vehicles without exception i.e. two wheelers, three wheelers, four wheelers, light vehicles and heavy vehicles irrespective of whether commercial or otherwise. 3. RTO shall not issue/renew registration of the vehicles or fitness certificate to any vehicle which is more than 15 years old (Action has already been initiated by Transport Department, GNCT of Delhi. The motor vehicles violating the directions of National Green Tribunal i.e. more than 15 years old should be prosecuted under section 39/192 Motor Vehicles Act, 1988( deemed to be an ‘ unregistered motor vehicle’) and should be mandatorily impounded under section 207 motor Vehicles Act, 1988 except those motor vehicles whose registration certificates have renewed by the registering authority before the date of order of National Green Tribunal under the provisions of section 41(7) of Motor Vehicles Act, 1988 read with rule 52(1) of Central Motor Vehicles Rule,1989.
