OBJECTIVE OF THE ACT The sole aim and objective of this enactment is to administer social justice to the apartment owners and other residents, who reside in luxury Condominiums. The main thrust of this Act No. 16 of 2010 is on the promotion of Construction, Ownership and Maintenance, and also, on the welfare and expediency of the apartment owners and other residents. The law makers appreciated, conceived and evolved the concept of the ownership of an Individual Apartment in a building, together with an undivided interest in the common areas and facilities, appurtenant to such apartment. The rulings of the Hon’ble High Courts and the Supreme Court have also been cited at the relevant places. The Commercial Activity of mushroom construction of Apartments, Flats, Villas, Luxury Condominiums, Malls etc. has been going on, with impunity, by the promoters/developers/realtors, etc. for an appreciable length of time with a view to tackling and solving the housing problem, created by reason of the incessant rise in urban population.
