Canadian Museum of Human Rights I will be taking a trip to view this museum - while walking this morning I also noted other institutions that have had an impact on First Nations rights. During my walk I reflected on: How First Peoples/Nations went from autonomous prosperous governing nations then; - 1850 Indian Act and 1867 Confederacy Leading to - Oppression, Dispossession, Exclusion - up to 1950s Indian (First Nation) peoples not allowed legal representation - mid 60s Indian (First Nation) peoples allowed to vote in off reserve politics - 1969 White Paper - proposal to wipe away the recognition of Indian Peoples and Culture - it DID NOT PASS - 1970s Indian Brotherhood - today Assembly of First Nations - Charlotte Town Accord and the 1982 Patriation of Canadian Constitution - entrenching protection of Aboriginal and Treaty Rights - Royal Commission on Aboriginal Peoples 1996 - The call for a new relationship. - Canada offers apology in 2008 for the Residential Schools and its assimilation policies. - Canada becomes a signator in 2010 (passed internationally at UN in 2007) to the UN Declaration on Indigenous Peoples Rights - Most recently application of the Human Rights Charter to the Indian Act 2011 NOTE - Supreme Court Rulings on Consultation and Aboriginal Rights from Calder 1973s (20years in Courts) to Tchilcotin 2014 - Aboriginal Title case. Predictions: Reconciliation needs to address Division of Powers Section 92 (Provinces right to manage/develop resources) and Section 35 protection of Aboriginal - Treaty rights; it will require bravery to rewrite Confederacy premised on a collaborative approach. 2015 Full reconciliation will occur when FN, Provincial and Federal Govts write First Peoples/Nations back into Confederacy 2020 All Govts continue collaborate and implement the respectful approach of Nationhood - Treaties - Federalism - and the required transfer payments to build a sustainable adaptive home for all on Turtle Island 2030 My opinion: Why the urgency? Every 10 years we ALL run. the risk of losing a generation. However - we ALL in Canada are becoming stronger and this can be accelerated with inclusion and empowerment with the First Peoples/Nations.
