Cut and Paste Letter of Formal Complaint. [via Tracy Lee] To the Superindentt An Garda Síochána [Insert Addresss:] A Chara, I would like to make a formal complaint that I believe a crime has been committed which warrants immediate investigation. The details are as follows: Section 6(1) of the Criminal Justice (Theft and Fraud Offences) Act 2001 states "a person who dishonestly, with the intention of making a gain for himself or herself or another, or of causing loss to another, by any deception induces another to do or refrain from doing an act is guilty of an offence". It would seem that in the case of the then management and directors of Anglo Irish Bank prior to its winding up that the following occurred. The Management and directors of then Anglo Irish Bank acted as follows: (a) dishonestly, (b) with the intention of making a gain for the bank or its bondholder, or of causing loss to the State, (c) by deception induced the State to give a guarantee and thereby are possibly guilty of an offence or at acted in way which corresponds with the Section 6(1) of the said Act and which at least merits immediate investigation by the Gardaí. Much of the evidence is presently in the public domain, the Dáil Records, the Promissory Notes, the Guarantees themselves, the Bank Reports, the tapes currently being published by the Irish Independent, which for the first time clearly show the deception, which is an essential ingredient in this crime. Any investigation must surely uncover further evidence upon which a succesful prosecution could be founded. Even though the Statute of Limitations does not place any restriction or time limit on a prosecution for fraud, I believe that the investigation should have happened a long time ago but that now there is no excuse. Any further delay could hamper or prejudice a trial. Please acknowledge receipt of this complaint of an offence under Section 6(1) of the Criminal Justice (Theft and Fraud Offences) Act 2001 in writing as follows: (a) Details Pulse Identification Number (b) Confirmation that an investigation into Fraud under Section 6(1) of the Criminal Justice (Theft and Fraud Offences) Act 2001 has commenced. (c) If such an investigation has not commenced, please furnish details as to why. (d) If such an investigation will not be initiated, please furnish details as to why. (e) If this complaint and investigation has been or will be referred to other Garda Authorities furnish full details of the referral and in particular: a. The Garda Office to which it has been referred. b. Details of the Head of the Investigating Officer, Investigation Department (Garda Bureau of Fraud Investigation or whatever), including contact details c.
