I DO POST IT FOR MY ALL FRIENDS TO READ AND BE ACQUAINTED WITH MY VIEWS ON THE ROLE OF A LEARNED COUNSEL. one of the settled principles of law is that every person is presumed to be innocent till his guilty is proved in the court of law. this principle is to be strictly followed by judges and counsels. a learned counsel has to presume that his client is innocent and presuming so he has to argue. if suppose a counsel refuse to argue on the mere conjecture and surmise that his client is guilty then dont you think great injustice is likely to occur. and then the judge can not reach conclusion who is right who is wrong. in case of laloo , laloo says he has been implicated , cbi says he is guilty and the court held him guilty. one of the foundations of natural justice is that a person ought not to be held guilty unless he has been given adequate opportunity to be heard (audi alteram partem- hear the other side). a cousel actually is expected to meet this great need of natural justic when he is engaged by a clent. a client has to be heard by the court via lawyer otherwise the justice will be defeated.
