Disability Community Wins Against City’s Appeal in Voting Rights Case A lawsuit, Disabled in Action, et al. v. Bd. of Elections in the City of New York, et al., litigated by Disability Rights Advocates, charged that the New York City Board of Elections failed to provide meaningful access to voters with disabilities. CIDNY’s poll site surveys provided strong evidence in the case. The lawsuit was decided in favor of the community in 2013. The City then appealed the verdict. The U.S. Court of Appeals today affirmed the original decision in favor of the disability community! In its conclusion the Appeals Court wrote: We conclude that the district court correctly held that BOE has failed to grant voters with disabilities meaningful access to its voting program. We also find that the remedial order is a proper exercise of the district courts authority to grant equitable relief. Accordingly, the order is AFFIRMED. To see the full decision, click below.
