Do you know what is holding back the availability of cyber insurance? Lack of transparency about data breaches. Imagine that! Kirk Arthur, supervisory special agent for the U.S. Secret Service’s San Francisco field office tells an audience of insurance professionals that businesses are not reporting breaches like they should. (See: “Secret Service Agent Says Many Cyber Breaches Go Unreported,” by Don Jergler, March 7, 2014). insurancejournal/news/west/2014/03/07/322748.htm The Department of Homeland Security has also taken notice, and according to their recent readout report, cyber incidents are not being reported due to “potentially negative regulatory or reputational consequences” (HIPAA). The lack of reliable data makes actuarial analyses impossible. Insurers won’t risk assets without actuarial analyses, and providers have huge disincentives to properly report data breaches. And in the end, cyber insurance won’t solve this problem, it will only increase regulations for providers. The costs and liabilities for storing patients identities on office computers are only getting worse. Dentists have a potential HIPAA compliant alternative: De-identification of primary dental records… And why not? Anyone? So why do you refuse to discuss de-identification with me, American Dental Association? Is it your pride that gets in the way? Americans deserve more transparency from you as well.
